Mexican envoy kidnapped, freed in Venezuela (Reuters)

CARACAS (Reuters) ? Mexico's envoy to Caracas was seized overnight then freed on Monday in the latest high-profile kidnapping in Venezuela, where violent crime is routinely listed as citizens' No. 1 worry.

In the classic style of "express" kidnappings that are rife in Venezuela, four armed men seized ambassador Carlos Pujalte and his wife in their car after a reception in the upscale Country Club zone of Caracas around midnight (0430 GMT), diplomats and officials said.

The kidnappers released the couple in a slum before dawn.

"We're so happy he is safe, I've been up following the case all night," said a senior European diplomat, whose own security has been increased in recent months.

Kidnappings, armed robberies and murders are common in the South American OPEC member nation that has enormous oil wealth alongside widespread poverty.

Venezuela's Attorney-General's office said a full investigation was underway.

Mexican Embassy spokesman Fernando Godinez said his boss was recovering fine after his release.

"His health is ok. He and his wife are giving statements (to the police) right now," Godinez told a local radio station. "We regret this situation deeply."

Senior diplomats from Chile and Belarus were also seized in similar incidents last year, according to diplomatic sources.

The Chilean consul, Juan Carlos Fernandez, was injured by a bullet, and beaten during his November kidnapping.

Robbery was the assumed motive of those incidents.

SCARY STATISTICS

"We don't know yet what happened last night, if they robbed the Mexican ambassador or asked for a ransom or what," said a foreign security expert at one of the embassies in Caracas, who was tracking the case closely. "It's a worrying trend though."

Late last year, Major League Baseball player Wilson Ramos, a catcher for the Washington Nationals, also was kidnapped for two days during a visit home, before being released during a raid by security forces on a mountain hideout.

Crime is arguably the top issue for voters in the run-up to an October presidential election.

Police are often involved, and murder rates make Caracas one of the most dangerous cities in the world, ranking with some war-zones.

Though rich and poor alike complain constantly about crime in Venezuela, the issue has traditionally not weighed heavily on President Hugo Chavez's approval ratings.

The latest poll released on Monday by the local Hinterlaces company gave him a 64-percent approval rating, with 50 percent of those surveyed saying they would vote for him in October.

"Chavez supporters have a strong emotional attachment to him and this has led some of them to fail to assess the situation objectively despite the statistics and the growing evidence of the government's responsibility (for the crime problem)," said Venezuelan analyst Diego Moya-Ocampos of the IHS Global Insight thinktank.

Interior Minister Tareck El Aissami says Venezuela's official annual murder rate is around 48 per 100,000 residents, but non-governmental organizations put the figure higher.

The Venezuelan Violence Observatory, for example, said murders had doubled in the last decade to reach a record of more than 19,000 - or about 60 per 100,000 people - in 2011.

"But in Venezuela we have not had a war. How can this be explained?" the NGO asked in its latest publication, saying political polarization underpinned the problem.

G-cluster plans mobile gaming service to challenge OnLive ...

Japanese cloud-gaming and VOD startup G-cluster plans to enter the U.S. market with an on-demand mobile gaming service, presenting a possible challenge to OnLive. The company has secured an unnamed amount of funding from Intel and Vivendi?s French mobile carrier SFR to expand its reach beyond home casual gaming and movie streaming into high-end gaming for tablets and smartphones.

G-cluster has already established itself in France, providing a casual gaming service through SFR?s residential broadband arm that customers can access through their TVs and set-top boxes or on their Macs or PCs. In Japan, G-cluster is offering an HD movie-on-demand service to connected TVs. But according to Sevan Kessissian, G-cluster VP of Content and Strategy, the startup has bigger ambitions than just casual gaming and video in the domicile. It plans to combine the processing might of the cloud and low-latency, high-bandwidth connections of new wireless networks to create a mobile service that supports high-quality, real-time gaming to tablets and other mobile devices. And it plans to launch that service in the U.S.

?We are in discussion with major partners in order to penetrate the US market? Kessissian said via e-mail. ?The game catalogue will be a blend of the best casual games and AAA games.?

Kessissian didn?t provide any details about which partners G-cluster is in discussions with or when such a U.S. service would launch, but when it finally does emerge here it may find an already established competitor in the market. In December, OnLive announced its mobile gaming service for iOS and Android devices.

My colleague Kevin Tofel reviewed OnLive?s mobile beta on the iPad, over both Wi-Fi and 3G, and was particularly impressed by its performance when hooked into his home network connection. As Kevin pointed out in earlier post, virtualization services like cloud gaming to the tablet and smartphone are proliferating, delivering one more blow to already suffering PC sales.

Google Music Manager: A frustrating way to download your music library (Digital Trends)

google-music-download-purchased-songs

Google Music users, you can breathe a slight sigh of relief, but don?t get too excited. Google has finally enabled a way for you to retrieve the music you upload to its new music storage locker service. The announcement was made on the official Android Market Web site.?

Using the Windows or Mac desktop PC client, you can now click one of two options. You can ?Download my library? or ?Download purchased music.? One of these options presumably downloads only the music you purchased from Google, while the other lets you download all of the music tracks that you have personally uploaded to the service.

A confused cloud

After hearing this news, I tried out the updated app on my Windows 7 machine this morning to mixed results. While it definitely seems to work (it downloads tracks), Google?s new download feature is extremely limited in functionality and its ability to detect which songs are purchased is completely broken. I tried to download only my ?purchased music,? thinking that there would be nothing in there except for the few free songs I?ve downloaded on Google Music, but to my surprise, Google Music believes that it now owns a hefty portion of my music library. Hundreds (maybe thousands) of tracks that were ripped from CDs, purchased on Amazon MP3, and given to me by friends are now all labeled as Google Music purchases for no good reason. If this wasn?t frustrating enough, to download music, you can only download all of it. For me, that means I have to download all 7,900 songs I?ve uploaded to Google Music.

There are options to download tracks from http://music.google.com, but you can only download each song or album two times. Yep, two (2) times?forever. If your computer is acting up and you don?t finish a download, well, too bad; you?ll have to use your last download to get your songs. Google announced this limitation for music purchased through Google, but it seems to apply to all music, even the music that you own and have uploaded to Google Music.

google-music-1-download-remaining

This album (above) was purchased and downloaded from AmazonMP3, and uploaded to Google Music. Google has no ownership of it, yet I am only allowed to download it once. If you download an album, but have already downloaded one of the songs on that album twice, that song will be skipped and you will be prompted to use the Music Manager to get the song. That means you?ll have to download thousands of items to get a single song. The Manager does have one good feature: You can choose to download only the songs that were added since your last mass download. This is useful, but we hope Google adds an auto-download feature that automatically downloads tracks to a PC when it?s added to Google Music. Moreover, it should be possible to upload tracks from an Android phone or tablet.?

On top of these troubles, Google?s Music Manager uploading has not operated well since launch. The software is a bandwidth hog, even when its upload speeds are dialed down. It seems to upload incredibly slowly, no matter what you do. I?ve been uploading my collection off and on since the service launched in June 2011, and have still only uploaded about 7,900 songs out of 12,000+. I don?t have a particularly slow connection either. I imagine if I let Google Music run straight and kept my computer on at night, it might take about a month to upload my tracks, maybe longer.?

Certain track features, like song ratings (1-5 stars) are not pulled in and converted into Google?s Thumbs Up or Thumbs Down system either, meaning hardcore users will have to re-rank their music.?

Android pinning problems

google-music-android-pinning-for-offlineI realize that this is a free service, and that Google has to deal with a lot of backward thinking music labels, but these limitations are confusing. Music labels may have good reason to force users onto a PC before they can download tracks, but it?s harmful to the entire experience. You cannot download unrestricted Google Music songs to an Android device either. You can choose to ?Pin for offline? any album, artist, or track, but those songs are not available outside of Google Music and there is no download dialog for them, so you don?t know if they are actually ?pinned? to your phone or not.

To touch on one last issue, the interface of the Google Music app for Android is improved with Android 4.0, but it?s still quite unpolished when compared to the included music players in Windows Phone and iPhone.

Why not charge?

As someone hunting for a cloud music solution, I?d almost prefer that Google offer a paid option for Google Music, which would give me full access to all of my tracks and the freedom to download them where I please, with the option to specify how the files are formatted and such. But for now, I sit and wait.?

Document: Dougherty sibling planned Colo. escape (AP)

DENVER ? One of three siblings who was part of a multistate crime spree and nationwide manhunt planned to escape from a Colorado jail with his sister, telling the FBI in a letter that he had enjoyed his stay, authorities said in a document released Friday.

Dylan Dougherty, 26, got out of his cell in Walsenburg, Colo., and wrote a note to his sister telling her he was going to break her out of jail, officials said. Dylan Dougherty is now being held at the Pueblo County Jail, some 45 miles north of the jail in Walsenburg where he was being held, along with his two siblings.

Dougherty's attorney, Cobea Becker did not immediately return phone messages.

During a Jan. 10 search, deputies found a homemade knife and letter to the FBI in his cell, according to an arrest affidavit.

Deputies also discovered that a panel in Dougherty's cell that allows access to the plumbing had been tampered with, as had the insulation just inside. A deputy followed the plumbing to the ceiling and discovered footprints in there, and in the female section of the jail, a letter addressed to his sister, Lee Grace Dougherty, 29, who was being held in that area.

Dylan Dougherty told his sister he planned to subdue the guards, steal their keys and escape with her. The note stated that when the FBI received the letter, he would be long gone from the Huerfano County Jail and he would leave the tools he used to escape behind, authorities said.

"I have enjoyed staying here, so don't take any of this personal," investigators quote the note as saying.

The letter to his sister said she should "have all her personal belongings ready, and that Dylan was going to get in through the ceiling to the control room where the detention staff are, and drop down on them," according to the affidavit. "He stated he would then tie them up and take the keys from them, and then they would just walk out."

Dylan Dougherty's was able to move around so freely in the ceiling that he was able to pass the note to his sister. Deputies discovered the note in the pod where she is being held, Huerfano County Sheriff Bruce Newman said.

"He's the first one who has ever gotten into one (an access panel)," Newman said. "All you can do is go from cell to cell. You can't escape from there."

Newman said the ceiling bumps into cinderblocks. As for Dougherty's plan to drop down into the control center, Newman said that area is enclosed by cinderblocks and not accessible from the ceiling.

"We've repaired the access panel and double locked them," Newman said.

The Doughertys and their brother, Ryan Dougherty, 22, were captured in southern Colorado on Aug. 10 after a chase, capping a nationwide search. All three had been held at the tiny jail that can hold up to 34 inmates in five pods that have two to four cells each. It was opened in 1989, Newman said.

Ryan Dougherty and Lee Grace Dougherty remain at the jail. Newman said there are no plans to move them elsewhere.

"With Dylan being the instigator of this and his being caught, the major part of this threat is gone," Newman said. "We're really a lot more alert and watching them a lot closer now."

Newman said there was some concern with holding all three in the same jail, adding that guards took stepped up security measures that included more impromptu searches ? called shakedowns _of Dylan's Doughtery's cell that uncovered the plan.

The three siblings are accused of robbing a Valdosta, Ga., bank and firing at a police officer in Zephyrhills, Fla., who was chasing their car when one of the suspects began shooting at his cruiser, disabling it, the FBI said.

In the Colorado chase, shots were fired at officers before the suspects' car rolled and crashed into a guardrail, authorities said.

Lee Grace Dougherty is set to go on trial Feb. 21 on attempted second-degree murder, assault and other charges related to the chase.

The brothers were granted a stay in proceedings until Monday, so federal and Florida prosecutors can decide how to proceed in the case.

In addition to charges stemming from the crime spree, Dylan Dougherty faces counts of conspiracy to escape and possession of contraband for the escape plan discovered during the search, authorities said.

During a September hearing, a Colorado Springs detective testified that Ryan Daugherty, the youngest of the three, told him that they hatched a plan to rob a bank and take the money to flee to Mexico.

Ryan Dougherty had just been sentenced to register as a sex offender for a conviction of sending sexually explicit text messages to an 11-year-old girl.

The siblings' mother, Barbara Bell of East Palatka, Fla., told The Associated Press in August that her son was discouraged by the terms of his probation and feared the conviction would prohibit him from seeing his newborn son.

Authorities in Florida said all three siblings had been living together in Lacoochee, Fla., about 45 miles northeast of Tampa, and each had a criminal record. Lee Dougherty has charges pending against her in Florida for hit and run and had previously been charged with battery. Stanley Dougherty had been charged with marijuana possession.

Today Apple, Google, 5 Others Battle ?No Poach? Conspiracy Case

Antitrust Hearing Today7 of the world's most powerful tech companies have been accused of forming an antitrust conspiracy to suppress the compensation of their employees by entering into "no poach" agreements. Today, a San Jose judge will hear a motion to dismiss a class action civil lawsuit in which former employees seek damages from defendants Apple, Google, Adobe, Intel, Intuit, Pixar, and Lucasfilm. The damning evidence against the defendants from a 2010 Department of Justice investigation that I first uncovered last week, as well as the plaintiffs' opposition to the defendants' joint motion to dismiss the case indicate there is more than sufficient evidence for the case to proceed towards trial. If the defendants lose to or settle with the class that represents all full-time employees of these companies between 2006 and 2009, tens of thousands of Silicon Valley employees could be compensated.

See James Franco as Hugh Hefner! (omg!)

See James Franco as Hugh Hefner!

James, is that Hugh?

James Franco hit the Glendale, Calif. set of Lovelace on Thursday. The handsome, quirky actor, 33, was utterly transformed to film his cameo as none other than Hugh Hefner -- morphing into a younger version of the Playboy founder, 85.

PHOTOS: Celeb lookalikes

The normally hipster casual actor, artist and student wore Hefner's iconic red moking jacket and white scarf, with his hair in a 60s/70s style pompadour.

Starring Amanda Seyfried as porn star Linda Lovelace, the film made a last-minute casting switch this week: Mary-Louise Parker is replacing the ailing Demi Moore in the role of Gloria Steinem, a source confirmed to Us Weekly exclusively.

Geithner: Obama won't ask me to stay in a 2nd term (AP)

WASHINGTON ? Timothy Geithner said Wednesday that he doesn't expect to serve a second term as Treasury secretary. He said he doesn't think President Barack Obama would ask him to remain if Obama won re-election.

"He's not going to ask me to stay on, I'm pretty confident," Geithner said in a Bloomberg Television interview. "I'm also confident he's going to have the privilege of having another Treasury secretary."

Geithner is the only remaining top official on Obama's original economics team. He had considered leaving in August after the congressional battle over raising the debt limit was resolved.

Obama asked him to reconsider and remain in the Cabinet, and Geithner did. But the incident heightened expectations that Geithner would serve only through the 2012 election.

Geithner, who helped lead the administration's response to the 2008 financial crisis, has been a frequent target of criticism in his three years at Treasury. Many accused him of siding too closely with Wall Street in the government bailout of the financial system.

As the administration's highest-profile economic figure, Geithner been a lightning rod for criticism of its economic stewardship. Critics contend that government spending under Obama failed to keep unemployment from rising and gave the country record budget deficits.

But Geithner also received praise for his leadership in getting a sweeping financial overhaul through Congress and in the efforts he made to stabilize the financial system

Geithner's supporters also argue that the Treasury secretary provided Obama with sound advice on how to restructure the financial system. They note, too, that he successfully managed the government's $700 billion financial bailout to limit taxpayers' losses.

In the interview Wednesday, Geithner offered no hints of what he might do after leaving the administration.

"I'm very fortunate," he said. "I work with tremendously talented people, and this is one of the most important times in modern history to be in the world of economic policy and finance. And I work for a great president, who I believe in."

It isn't unusual for Cabinet secretaries to leave after just one term of a two-term presidency. George W. Bush and Bill Clinton both had three Treasury secretaries during their two terms in office.

The only Treasury secretary in recent history to serve more than four years was Nicholas Brady who served as Ronald Reagan's third Treasury secretary. Brady then stayed to serve for all four years of the George H.W. Bush administration.

Hiriko: The MIT-backed, Spanish 'folding' EV that wants to make cities bigger

Meet Hiriko, an EV that's the fruit of a collaboration between MIT, Basque businesses and the Spanish government. It might look like the rest of those sci-fi Jetson-style concepts, but it has a few tricks up its wheel-arches. Rather than a regular configuration, the bubble-esque ride has four independent in-wheel motors. Also, when you're ready to park this thing, the back section slides forward, "folding" the cabin up vertically -- a feat the makers claim will see it occupy only two-thirds of the space taken by a Smart ForTwo. Other neat features include a single front-opening door and joystick controls (rather than a plain old steering wheel). There's no details on range, mph and charge speed, but 20 test vehicles are being built at a reported cost of $16,253 each. There's no hint at what this will translate to in sticker price when it goes into production next year, but with the initial trials taking place imminently, it looks like Hiriko (meaning "of the city") could be a feature in your city quite soon.

Gaddafi supporters seize control of Libyan town (Reuters)

TRIPOLI (Reuters) ? Fighters loyal to Libya's overthrown leader Muammar Gaddafi took control of a town south-east of the capital on Monday, flying their green flags in defiance of the country's fragile new government.

The fightback by Gaddafi supporters defeated in Libya's civil war, though unlikely to spread elsewhere, added to the problems besetting a government which in the past week has been reeling from one crisis to another. Gaddafi himself was captured and killed in October after weeks on the run.

Accounts from the town of Bani Walid, about 200 km (120 miles) from Tripoli, described armed Gaddafi supporters attacking the barracks of the pro-government militia in the town and then forcing them to fall back.

"They control the town now. They are roaming the town," said a fighter with the 28th May militia, loyal to Libya's ruling National Transitional Council (NTC), which came under attack.

The fighter told Reuters the loyalists were flying "brand new green flags" from the centre of town. The flags were symbols of Gaddafi's 42-year rule.

A resident said four people were killed and 20 wounded in the fighting, during which the sides used heavy weapons.

Bani Walid, base of the powerful Warfallah tribe, was one of the last towns to surrender to the anti-Gaddafi rebellion last year. Many people there oppose the new leadership.

A Libyan air force official said war planes were being mobilized to fly to Bani Walid. A spokesman for the military council in Zawiyah, near Tripoli, said a 1,500-strong force, drawn from militias across western Libya, was on stand-by.

"If the situation in Bani Walid is still complicated , we will go there," the spokesman, Ayad Laaroussi, said.

But it was not immediately clear what the government in Tripoli could do. It has yet to demonstrate that it has an effective fighting force under its command and Bani Walid, protected behind a deep valley, is difficult to attack.

EMBATTLED GOVERNMENT

The uprising in Bani Walid could not come at a worse time for the NTC. In the past week its chief has had his office overrun by protesters angry at the slow pace of reform and the second most senior official has quit, citing what he described as an "atmosphere of hatred."

During Libya's nine-month war, anti-Gaddafi rebels tried to take Bani Walid but did not progress much beyond the outskirts of the town. It later emerged that Saif al-Islam, one of Muammar Gaddafi's sons who was captured in the Sahara desert in November, had been using Bani Walid as a base.

Soon before the end of the conflict, with Gaddafi's defeat unavoidable, local tribal elders negotiated an agreement under which forces loyal to the NTC were able to enter the town without a fight.

Relations have been uneasy since then and there have been occasional flare-ups of violence.

The resident, who did not want to be identified, said Monday's violence began when members of the May 28 militia arrested some Gaddafi loyalists.

That prompted other supporters of the former leader to attack the militia's garrison.

"They massacred men at the doors of the militia headquarters," said the resident.

A militia based in Tripoli said its fighters had captured 17 people who, it said, were part of a network trying to smuggle arms to Gaddafi loyalists in Bani Walid and elsewhere. The militia said in a text message that the weapons included Russian-made Grad rockets.

FRAGILE GRIP ON POWER

The NTC still has the backing of the NATO powers who, with their diplomatic pressure and bombing campaign, helped push out Gaddafi and install the new government.

But questions are now being raised inside some Western governments about the NTC's ability to govern Libya effectively and secure its borders against al Qaeda, arms traffickers and illegal migrants trying to get into Europe.

The NTC was pitched into its worst crisis since the end of the civil war at the weekend when a crowd of protesters in the eastern city of Benghazi stormed the council's local headquarters when NTC chief Mustafa Abdel Jalil was inside.

The protesters, who supported the revolt against Gaddafi, were angry that more progress had not been made to restore basic public services. They also said many of the NTC's members were tarnished by having served in Gaddafi's administration.

Abdel Hafiz Ghoga, deputy head of the NTC and target of some of the protests, said he was resigning. Abdel Jalil warned that the protests could drag the country into a "bottomless pit."

Obama to take on economy in State of the Union (AP)

WASHINGTON ? Addressing a divided nation amid a determined GOP campaign to take his job, President Barack Obama is preparing to issue a populist cry for economic fairness as he aims to corral the sympathies of middle-class voters 10 months before Election Day.

Obama delivers his third State of the Union address Tuesday in a capital and country shot through with politics, with his re-election campaign well under way and his potential GOP opponents lobbing attacks against him daily as they scrap for the right to take him on.

Obama's 9 p.m. EST address to a joint session of Congress and millions of television viewers will be as much as anything an argument for his re-election, the president's biggest, best chance so far to offer a vision for a second term.

Senior political adviser David Plouffe said Tuesday morning the president is "happy to have a debate" about his performance.

Bill Galston, a former Clinton administration domestic policy adviser now at the Brookings Institution, said, "Almost by definition it's going to be at least as much a political speech as a governing speech."

"The president must run on his record," Galston said, "and that means talking candidly and persuasively with the country about the very distinctive nature of the challenges the American economy faced when he took office and what has gone right for the past three years, and what needs to be done in addition."

With economic anxiety showing through everywhere, the speech will focus on a vision for restoring the middle class, with Obama facing the tricky task of persuading voters to stick with him even as joblessness remains high at 8.5 percent. Obama can point to positive signs, including continued if sluggish growth; his argument will be that he is the one to restore economic equality for middle-class voters.

Implicit in the argument, even if he never names frontrunners Gingrich and Mitt Romney, is that they are on the other side.

Obama's speech will come as Gingrich and Romney have transformed the Republican campaign into a real contest ahead of Florida's crucial primary next week. And he'll be speaking on the same day that Romney, a multimillionaire, released his tax returns, offering a vivid illustration of wealth that could play into Obama's argument about the growing divide between rich and poor.

Asked in an interview Tuesday about Romney's relatively modest tax rate in the range of 15 percent, given that he's a multi-millionaire, Plouffe said, "We need to change our tax system. We need to change our tax code so that everybody is doing their fair share."

Obama will frame the campaign to come as a fight for fairness for those who are struggling to keep a job, a home or college savings and losing faith in how the country works.

The speech will feature the themes of manufacturing, clean energy, education and American values. The president is expected to urge higher taxes on the wealthy, propose ways to make college more affordable, offer new steps to tackle a debilitating housing crisis and push to help U.S. manufacturers expand hiring.

Aides said the president would also outline more specifics about the so-called "Buffett Rule", which Obama has previously said would establish a minimum tax on people making $1 million or more in income. The rule was named after billionaire Warren Buffett, who has said it is unfair that his secretary pays a higher tax rate than he does.

White House communications director Dan Pfeiffer said on Twitter Tuesday that Buffett's secretary, Debbie Bosanek, would attend the State of the Union in the first lady's box.

Even before Obama delivered his speech, Senate Minority leader Mitch McConnell, R-Ky, said he already felt "a sense of disappointment."

"While we don't yet know all of the specifics, we do know the goal," he said. "Based on what the president's aides have been telling reporters, the goal isn't to conquer the nation's problems. It's to conquer Republicans. The goal isn't to prevent gridlock, but to guarantee it."

For three days following his speech, Obama will promote his ideas in five states key to his re-election bid. On Wednesday he'll visit Iowa and Arizona to promote ideas to boost American manufacturing; on Thursday in Nevada and Colorado he'll discuss energy; and in Michigan Friday he'll talk about college affordability, education and training. Polling shows Americans are divided about Obama's overall job performance but unsatisfied with his handling of the economy.

The lines of argument between Obama and his rivals are already stark, with America's economic insecurity and the role of government at the center.

The president has offered signals about his speech, telling campaign supporters he wants an economy "that works for everyone, not just a wealthy few." Gingrich, on the other hand, calls Obama "the most effective food stamp president in history." Romney says Obama "wants to turn America into a European-style entitlement society."

Obama will make bipartisan overtures to lawmakers but will leave little doubt he will act without their help when it's necessary and possible, an approach his aides say has let him stay on offense.

The public is more concerned about domestic troubles over foreign policy than at any other time in the past 15 years, according to a new survey by the Pew Research Center. Some 81 percent want Obama to focus his speech on domestic affairs, not foreign ones; just five years ago, the view was evenly split.

On the day before Obama's speech, his campaign released a short Web ad showing monthly job losses during the end of the Bush administration and the beginning of the Obama administration, with positive job growth for nearly two Obama years. Republicans assail him for failing to achieve a lot more.

House Speaker John Boehner, responding to reports of Obama's speech themes, said it was a rehash of unhelpful policies. "It's pathetic," he said.

Presidential spokesman Jay Carney said Monday that Obama is not conceding the next 10 months to "campaigning alone" when people need economic help. On the goals of helping people get a fair shot, Carney said, "There's ample room within those boundaries for bipartisan cooperation and for getting this done."

Plouffe appeared on ABC's "Good Morning America" and was interviewed on NBC's "Today" show and "CBS This Morning."

Kelly Clarkson Covers "I'd Rather Go Blind" in Honor of Etta James

Beyonce is not the only star who has had the honor of channeling the late Etta James in a performance -- Kelly Clarkson has a story, too.

PHOTOS: See Beyonce as Etta James

During her concert at Radio City Music Hall in NYC Saturday, the singer paused to pay tribute to the blues legend, who passed away from leukemia at the age of 73 Friday, and belted out James' hit, "I'd Rather Go Blind."

In a way, the music icon helped kick off Clarkson's music career. Back in 2002, Clarkson, 29, won over the ears of Simon Cowell, Paula Abdul and Randy Jackson when she chose to sing James' "At Last" during her Dallas audition for the first season of American Idol.

After reigning as the FOX vocal competition's first-ever winner, the rest is history.

Recently, the "Mr. Know It All" singer has been tapped to be an advisor on The Voice, where she will help along the contestants' pipes who land on coach Blake Shelton's team.

Gingrich pushes for campaign cash (AP)

WASHINGTON ? Fresh off a resounding victory, Newt Gingrich faces a formidable financial challenge as he storms into Florida ? raising money.

The former House speaker ? whose campaign still is carrying debt ? has little choice but to move rapidly to convert momentum from his South Carolina triumph into dollars to spend in Florida, a much larger and more diverse state with multiple media markets that bear a hefty $2 million price tag to blanket the state with TV ads over the next week.

He's already working to tap into Rick Perry's deep base of donors, following the Texas governor's departure from the race and endorsement, as well as the vast grassroots network of his now defunct political group, American Solutions. And, even if aides won't publicly acknowledge it, Gingrich probably also is betting on his wealthy friends continuing to open their wallets to a political action committee working to help elect the former Georgia congressman.

Casino magnate Sheldon Adelson essentially saved Gingrich's campaign as the race turned to South Carolina almost two weeks ago by pouring $5 million into the Winning Our Future super PAC that aired ads tearing into chief rival Mitt Romney, helping pave the way for a Gingrich victory. With Gingrich now winning, it's tough to see how Adelson returns to the sidelines now.

Even before his South Carolina victory, a confident Gingrich said in Orangeburg, S.C.: "We will have what we need to compete."

But the urgency was clear in the minutes after The Associated Press declared him the winner Saturday night.

He quickly sent a tweet thanking supporters and appealing for a flood of donations for the Jan. 31 primary. "Help me deliver the knockout punch in Florida. Join our Moneybomb and donate now," said his tweet. And later, he pleaded in an email: "If you want to see a Reagan conservative as the nominee, and if you want to watch us run circles around Barack Obama in the debates with bold, conservative ideas, then please make a donation today."

Gingrich's campaign did not immediately respond to questions about whether the financial floodgates have opened in the wake of his victory.

Aides have said he raised roughly $9 million in the final quarter of last year. But the campaign still is carrying about a half a million dollars in debt from spring and summer when his campaign was struggling.

In that same time period Romney says he has raised $24 million. And he and his allies have been on the air in Florida ? alone ? for weeks, blanketing the state with his campaign pitch and targeting the thousands of Florida Republicans who have been casting absentee ballots since last month.

Given all that and with only nine days before the primary, there's no time for Gingrich to waste.

He was spending Sunday in Washington, attending a church service and working to raise money behind the scenes, including reaching out to former Perry donors who helped the Texas governor raise $17 million during the third quarter of 2011.

A giant plea for money also greeted visitors to Gingrich's website Sunday in hopes that fans of his books and time on the speaking circuit would donate.

Gingrich will have help.

Super PACs, like the pro-Gingrich Winning Our Future that's independent of his campaign, are certain to play aggressively in Florida, perhaps to a greater level than they did in Iowa, New Hampshire and South Carolina.

The independent groups can spend unlimited amounts of money in elections since federal court rulings in 2010 stripped away previous restrictions. The super PACs can't coordinate with campaigns, but many ? including Gingrich's and Romney's ? are staffed by people with ties to the candidates.

Already the pro-Romney super PAC ? Restore Our Future ? has spent a jaw-dropping $4 million in advertising in Florida, with Romney himself doling out nearly $2.5 million. Gingrich and his allies have yet to run an ad in the state.

At a deficit already, Winning Our Future and others supporting Gingrich expect that the spigot of money will continue flowing.

Still, they will be competing for dollars with super PACs supporting other candidates, particularly the Red, White and Blue Fund that's supporting former Pennsylvania Sen. Rick Santorum.

"Even if he gets 1 percent in South Carolina, I'm still for Rick," said Foster Friess, a Wyoming businessman who's been a major backer to the Santorum-leaning super PAC.

Gingrich's reliance on outside support is a reversal. He decried the influence of the independent groups in Iowa as they battered him in the state, and pledged to run a positive campaign. Then he kept losing. And a super PAC rushed to his defense.

The candidate himself has struggled to raise money this year despite being known for his fundraising prowess that dates to the 1990s when he engineered the Republican takeover of the House. After he left Congress, he turned his conservative political group, American Solutions for Winning the Future into a fundraising powerhouse, using the cash to continue a busy travel schedule that kept his name in the news. Gingrich owns the groups donor list.

When his campaign imploded last year, Gingrich relied on using that grass-roots network and social media to raise money.

"He's done well with less money than Romney," said John Grant, a Baptist leader and one of Gingrich's Florida evangelical chairmen. "It's because he's the atypical candidate."

'Extinct' monkey rediscovered in Borneo by new expedition

Friday, January 20, 2012

An international team of scientists has found one of the rarest and least known primates in Borneo, Miller's Grizzled Langur, a species which was believed to be extinct or on the verge of extinction. The team's findings, published in the American Journal of Primatology, confirms the continued existence of this endangered monkey and reveals that it lives in an area where it was previously not known to exist.

Miller's Grizzled Langur (Presbytis hosei canicrus) is part of the small primate genus Presbytis, found across Borneo, Sumatra, Java and the Thai-Malay Peninsula. In Borneo, P.h. canicrus is only found in a small corner of the county's north east and its habitat has suffered from fires, human encroachment and conversion of land for agriculture and mining.

The team's expedition took to them to Wehea Forest in East Kalimantan, Borneo, a large 38,000 ha area of mostly undisturbed rainforest. Wehea contains at least nine known species of non-human primate, including the Bornean orangutan and gibbon.

"Discovery of P.h canicrus was a surprise since Wehea Forest lies outside of this monkey's known range. Future research will focus on estimating the population density for P.h. canicrus in Wehea and the surrounding forest," said Brent Loken, from Simon Fraser University Canada. "Concern that the species may have gone extinct was first raised in 2004, and a search for the monkey during another expedition in 2008 supported the assertion that the situation was dire."

By conducting observations at mineral licks where animals congregate and setting up camera traps in several locations, the expedition confirmed that P. h canicrus continues to survive in areas west of its previously recorded geographic range. The resulting photos provide the first solid evidence demonstrating that its geographic range extends further than previously thought.

"It was a challenge to confirm our finding as there are so few pictures of this monkey available for study," said Loken. "The only description of Miller's Grizzled Langur came from museum specimens. Our photographs from Wehea are some of the only pictures that we have of this monkey."

"East Kalimantan can be a challenging place to conduct research, given the remoteness of many remaining forested areas, so it isn't surprising that so little is known about this primate," said Dr. Stephanie Spehar, Assistant Professor of Anthropology at University of Wisconsin Oshkosh. "We are very grateful to our local partners. This discovery represents the hard work, dedication, and collaboration of Western and Indonesian scientists, students, NGOs, as well as local communities and government."

"While our finding confirms the monkey still exists in East Kalimantan, there is a good chance that it remains one of the world's most endangered primates," concluded Loken. "I believe it is a race against time to protect many species in Borneo. It is difficult to adopt conservation strategies to protect species when we don't even know the extent of where they live. We need more scientists in the field working on understudied species such as Miller's Grizzled Langur, clouded leopards and sun bears."

U.S. could hit debt ceiling again around election (Reuters)

WASHINGTON (Reuters) ? The latest $1.2 trillion increase in the U.S. debt limit may not last through November's election and could provide fresh ammunition for Republicans to attack President Barack Obama on what they see as a particularly vulnerable point - spending.

Based on current deficit rates and borrowing estimates, some analysts say the United States could reach the debt ceiling again before the November 6 vote. This would force the U.S. Treasury to turn once more to accounting maneuvers to avoid the unthinkable: asking Congress for another increase as the presidential election campaign reaches its crescendo.

But any moves by the Treasury would likely not stop the issue from becoming fodder for Republican attack ads.

Estimates on when the United States will reach its debt limit vary, but they leave little room for the Treasury to cope with an economic shock, such as a global slowdown triggered by a worsening of Europe's debt crisis, which could shrink U.S. revenues and boost spending on unemployment aid.

"If the debt ceiling were to breached before the election, it would be possibly nuclear," said Ethan Siegal, who advises institutional investors on Washington politics.

A full replay of last summer's debt limit battle, which brought the United States to the brink of default and prompted a U.S. credit rating downgrade from Standard & Poor's, would rattle markets and put Obama at the mercy of Republicans in the House of Representatives bent on slashing spending.

A central theme of the Republican election strategy to recapture the White House is to portray Obama as presiding over a spending binge that has seen U.S. deficits surge to record levels, although the White House counters that the outlays were necessary to prevent the 2007-2009 recession becoming another Great Depression.

In a largely symbolic protest, the Republican-controlled House voted on Wednesday to reject the latest $1.2 trillion increase.

"There is a chance that we will burn through the debt limit increase by the election," said Lou Crandall, chief economist at Wrightson ICAP LLC in Jersey City, New Jersey. "It is unlikely that we would burn through the total amount and all the normal accounting maneuvers."

$300 BILLION SHORT

The budget deal that lifted the debt limit last summer was originally meant to last through 2012 and take the issue off the table for the election. But Obama never got the total potential increase of $2.4 trillion because a congressional deficit-cutting "super committee" failed to agree on discretionary spending cuts.

This limited the increase to $2.1 trillion, moving the timetable for again reaching the debt limit forward by two to three months at current deficit rates.

So far in fiscal 2012, which started October 1, the federal deficit has averaged $107.25 billion per month, just under the monthly pace for all of last year. At this burn rate, nearly $1.1 trillion of the $1.2 trillion increase would be consumed through October, leaving a cushion of only about $100 billion heading into the election.

And on November 15, Treasury will need to refinance about $88 billion worth of maturing debt as well as make a hefty interest payment.

Goldman Sachs analyst Alec Philips estimates that Treasury will reach the new debt ceiling of $16.394 trillion around mid-November, forcing Treasury to take accounting measures to get through the post-election "lame duck" session of Congress.

However, he noted that the strength of government revenues are difficult to predict.

Another source of uncertainty is the prospect of further capital injections into government-controlled housing finance giants Fannie Mae and Freddie Mac. The regulator for Fannie and Freddie has estimated that they could need up to $52 billion more in net taxpayer funds through 2014.

Of course, government revenues also could surprise on the upside if the U.S. economic recovery and job growth gains momentum this year. New budget deficit estimates are due in the coming weeks from the White House, the Congressional Budget Office and the Treasury's stable of Wall Street bond dealers.

These estimates are currently in the $1 trillion to $1.3 trillion range for the fiscal year ending September 30.

White House officials acknowledge that the United States will be close to the ceiling again around the time of the election but said the Treasury's accounting maneuvers could keep the government liquid until after the vote, and Congress would have to raise the limit shortly thereafter.

For Obama, the question is to what extent a re-emergence of the debt limit issue will focus a spotlight at the 11th hour of the election campaign on spending and debt accumulation during his tenure.

"The debt ceiling itself is sort of symbolic of the government not being able to figure out how to cut back spending and if that debate were to rise up with an event bringing it to the forefront of headlines, it's a problem for him," said Siegal, who heads The Washington Exchange.

Linux Foundation Expects More Enterprise Gains in 2012

linux-on-the-riseThe Linux Foundation is sharing the results of their latest invitation-only survey of enterprise Linux users. Their last such survey, in August 2010, revealed Linux was gaining popularity in enterprise computing. It should come as no real surprise that the latest survey shows more of the same. A lot has happened since late 2010, and the Linux Foundation survey reflects that. In "Linux Adoption Trends 2012: A Survey of Enterprise End Users" we find that a substantial number of enterprise users "expressed concern with the rapid growth of data, and Linux is clearly the platform of choice to address it." Less than half of respondents are planning to use Windows to handle their "Big Data" requirements.

BMW's DesignworksUSA, Thermaltake reveal Level 10 M gaming mouse concept

Themaltake and BMW's DesignworksUSA are apparently a design-team match made in PC gaming heaven. After previously partnering up for the elegant (and functional) Level 10 modular PC case, the two are back at it again -- this time with a focus on peripherals. While details are sparse, the Level 10 M mouse concept you're looking at is the first of the bunch to be revealed, and it's said to arrive sometime during the spring. It's not exactly a shoo-in for MadCatz's Rats, but considering the wire and an aggressively breathable design, it's clearly aimed at pro-gamers. Sadly, key specs like its DPI rating and details about any macro functionality are currently non-existent, however, it does appear to be of the optical variety. Here's to hoping it'll perform just as good at as looks to the eyes, and for now, hit up the press release past the break for a totally vague description.

SOPA, PIPA protest held at senators' offices

Craig Kanalley

Protesters participate in an emergency New York Tech Meetup, held Wednesday at 49th Street and 3rd Avenue in New York City to protest the SOPA and PIPA legislation.

By Craig Kanalley, Social Media Editor, NBC News

As?the Internet orchestrated a massive protest Wednesday against the SOPA and PIPA bills, with blackouts on Wikipedia and beyond, hundreds of tech enthusiasts took that protest to the streets in New York City.

"We are real. We exist in three dimensions, not just online," David Segal, executive director of Demand Progress, said to cheers.

Speakers spoke passionately at the "emergency" New York Tech Meetup outside the offices of Senator Chuck Schumer and Senator Kirsten Gillibrand on 3rd Avenue in New York. Both senators, who are Democrats, support the SOPA/PIPA legislation.

"We built this bridge for the past 15 years," Sara Chipps of Girl Develop It said of the Internet. She asked if anyone has the right to tell people how to use it or who to meet on it. She then added, "If they tear it down, we can build another one."

Jessica Lawrence, managing director of the New York Tech Meetup, said the event was organized just a week ago to speak out against the SOPA and PIPA bills, which she says would stifle innovation, free speech and economic growth.

Meetup CEO Scott Heiferman?addressed the senators' stance on the issue directly, pointing up to their offices.

"I like our senators up there, they're good people, but I think they're bought off by Hollywood and big media, and the Internet is made up of people," he said. "The Internet is a network of people."

Many different arguments against SOPA and PIPA were discussed, especially those Lawrence mentioned.

Tim Carr of Free Press put it this way: "Democracy can't work with the internet today if you don't have an internet based on democratic principles."

Occasional "Mic Checks" broke out before and after today's event, a sign that energy from the Occupy movement had also fused into the fight against the SOPA and PIPA bills. That also seems to be happening on Twitter.

Attendees were urged to tweet Gillibrand and Schumer, telling them not to support PIPA. (Two Republican senators,?Marco Rubio of Florida and John Cornyn of Texas,?withdrew their support?of PIPA in light of Wednesday's Internet protests.)

One attendee, Clay Shirky, tweeted this just after the protest: "Dear?@ChuckSchumer?and?@SenGillibrand, citizens who turn out on a cold Jan day to protest will turn out on a cold Nov day to vote."

In addition to those who braved the cold, the protest was also?watched on Livestream, viewed 11,000 times at the time of this writing. It can be viewed again in its entirety here.

New weapon aimed at Occupy: lynching charge

http://youtu.be/8UAj4Ohsce4

Screen grab from youtube video showing the arrest of Occupy LA activist Sergio Ballesteros on Thursday, Jan. 12. Ballesteros, 30, was released on $50,000 bail early Tuesday. He is charged with "lynching"--a felony charge originally drafted to deal with vigilante mobs.

By Kari Huus, msnbc.com

Sergio Ballesteros, 30, has been involved in Occupy LA since the movement had its California launch in October. But this week, his activism took an abrupt turn when?he was arrested on a felony charge ? lynching.

Under the California penal code, lynching is ?taking by means of a riot of any person from the lawful custody of any peace officer," where "riot" is defined as two or more people threatening violence or disturbing the peace. The original purpose of the legal code section 405(a)?was to protect defendants in police custody from vigilante mobs ? especially black defendants from racist groups.

Whether the police allegation in this case will be pursued by by California?s courts is uncertain. But the felony charge ? which carries a potential?four-year prison sentence ? is the kind of accusation that can change the landscape for would-be demonstrators.

Occupy protesters bring their discontent to Congress

"Felonies really heighten the stakes for the protesters," said Baher Azmy, legal director at Center for Constitutional Rights in New York. "I think in situations where there are mass demonstrations and a confrontation between protesters and police, one always has to be on the lookout for exaggerated interpretations of legal rules that attempt to punish or squelch the protesters."

Ballesteros, a teacher-turned-social-activist,?was one of two people arrested during an "art walk" in downtown Los Angeles on Thursday. He and other Occupy LA activists ? maybe 200, he said ? had joined the procession to bring their message about social injustice to the thousands of gallery-goers.

Adam Alders, a protester who was playing a drum was arrested after stepping off the curb into the street.?Ballesteros said that in doing so, the drummer was joining hundreds of other people who could not fit on the crowded sidewalk.

Occupy protesters underwhelmed by senator's staff

Ballesteros said he was across the street when he saw the arrest ? which he said looked excessively rough -- and it was ?startling.? Under legal advice, Ballesteros is not providing additional detail, but apparently he objected ? in some fashion ? to the arrest. A video of the crowded scene posted on YouTube?shows Ballesteros on the ground, being handcuffed.

The police report says officers called for backup when Ballesteros pulled Alders out into the crowd, which was "hostile."

A video of the event shows the crowd chanting "let him go!"

He was booked into jail on a felony charge, the Los Angeles Police department confirmed, and released on $50,000 bail early Tuesday morning.

'I can't go out and express myself'
Ballesteros is not the first protester to face this 1933 California law.

Occupy Oakland activist Tiffany Tran, 23, was arrested?Dec. 30 and charged with "lynching." At an arraignment four days later,? prosecutors opted not to file the charges,?the San Francisco Bay Guardian reported. They could change their minds until the one-year statute of limitations expires.

"Now I feel I can?t go out and express myself as I should be able to," Tran told the paper.

Houston DA turns up the heat on Occupy activists?

In the handful of protest cases in which lynching has been used as a charge?in the past, it later has been dropped. However, in one case, a court concluded that ?lynching? could include ?a person who takes part in a riot leading to his escape from custody."

Many states have laws against lynching ? largely drafted to prevent white supremacists and other vigilante groups from using violence against African Americans?and?white people who supported them. Hundreds of lynchings of this sort took place in the late 1800s through the mid-1900s.

Ballesteros' lawyer?said?use of this?law was perhaps less appealing to the District Attorney than to the police.

Ballesteros is an activist?outside the Occupy movement -- building homes through Habitat for Humanity during his spring breaks, aiding at a children's camp for the poorest kids in the Appalachians during the summer, and acting as mentor for kids in the Los Angeles area.

"Whether the District Attorney has the stomach to charge this model young man with a felony is questionable," saidd Mieka ter Poorten, an LA criminal defense attorney who is handling this case pro bono.

Trying to silence?
Ballesteros, who?spoke to msnbc.com on Tuesday, said that he does not believe he will be convicted of lynching.

?They don?t have much,? he said of the case against him.

Ballesteros lawyer, Meika ter Poorten, who is working pro bono on the case, says

He also faces a misdemeanor charge for his arrest?Nov. 30, when he was among more than 200 people who defied eviction from an encampment on the grounds of Los Angeles' City Hall. There was an arraignment for protesters arrested that day, but they were told no charges yet had been filed.

?They have a year to do so,? said Ballesteros. "Now they certainly will. It?s obvious. It?s all political.?

Ballesteros took part in a live video forum between Occupy movement activists and Tea Party activists just a day before his arrest. Click here to hear the discussion.
